If the LOCKOUT light is displayed, your vehicle is temporarily inoperable because of too many fails or aborts. This temporary lockout will last for 2-5 minutes. When the message is cleared from your device you will be able to retest.

2. Both the SERVICE and LOCKOUT lights are glowing on my device.

If both the SERVICE and LOCKOUT lights are glowing, but NOT flashing, your vehicle is inoperable and your device and vehicle are in permanent lockout. You are not able to test during a permanent lockout. You should call your service provider to make arrangements for your device to be reset.

3. Both the SERVICE and LOCKOUT lights are flashing on my device.

If you are past due for your scheduled program monitoring or if you are in early recall, both the LOCKOUT and SERVICE lights will flash.  The number of times the lights flash together in sequence translates to the number of remaining days before the device goes into a permanent lockout. You should call your service provider immediately to schedule an appointment for service and monitoring.

4. The WAIT light is staying on for a long time.

The WAIT light may stay on for an extended period of time during cold weather. The unit will remain on WAIT until it has warmed up to operate properly. Ask the technician at your next service appointment about setting a warm-up time on your device to help reduce your ‘WAIT’ time.

5. The POWER light keeps flashing and will not allow me to take a test.

If the POWER light keeps flashing this indicates that your vehicle’s battery is weak or its voltage is low.

6. The ABORT light is on after I breathe into the device.

The ABORT light appears if an improper breath test was given. The device did not receive either the correct amount of air pressure and/or the hum tone that was needed. This is NOT a fail. Continue to test as normal.

7. What is the address and directions to the location where my vehicle will be serviced?

8. What do I need to do if my car needs a tune up or other service?

If your vehicle needs an oil change or other routine service, nothing special needs to be done. If the power to your interlock device needs to be disconnected during the service, you will need prior documentation prior to your vehicle’s service. Contact us for more information on the documentation.

9. What happens if I need to cancel my service appointment?

If you cancel less than 24 hours before an appointment or do not show up for your appointment, you will be charged a missed appointment fee.

10. What happens if I miss my service date?

If you do not show up for your service appointment, you will be charged a missed appointment fee. Your vehicle will go into permanent SERVICE LOCKOUT mode and you will need to have your vehicle towed to the service location. Most jurisdictions are notified of a permanent SERVICE LOCKOUT.

• Ignition interlock devices reduce recidivism among both first-time and repeat offenders, including “hardcore” offenders—those offenders who repeatedly drive after drinking with high Blood Alcohol Concentrations (BACs) and are resistant to changing this behavior.
• More than 10 evaluations of interlock applications in various states have demonstrated reductions in recidivism ranging from 50 to 90 percent while the interlock is installed on the offender’s vehicle.
• Once ignition interlocks are removed from vehicles, recidivism rates of ignition inter­lock users are similar to the rates for offenders who did not install ignition inter­locks.  Because of the increased recidivism rates following the removal of an interlock device, several studies have reported that interlocks may be necessary as a long-term or permanent condition of driving for repeat offenders.

Some specific research studies found the following:

• A study in New Mexico found that participation in their interlock program reduced recidivism by 50 percent.
• A study in Maryland found that participation in their interlock program reduced recidivism by almost 65 percent.
• A study in Illinois found that participants in their interlock program had a reduced recidivism rate of 85 percent.

Organizing yourself as well as your case is the first step after a DUI citation. Cooperate and show respect for the legal process. A defendant who appears in court ready, accepting, and genuinely remorseful of his or her actions is often treated with more respect when the judge declares judgment.

Pennsylvania employs a three-tiered system of DUI offenses based on blood alcohol content (BAC), in which the consequences are increasingly severe.

• “General Impairment” is a BAC of .08 to .099 percent
• “High BAC” is .10 to .159 percent
• “Highest BAC” is .16 percent and higher.

Mandatory Jail Time – Individuals arrested for any level of a DUI in Pennsylvania can be sentenced to up to six months in jail. There is no mandatory jail time for a general BAC conviction, but individuals convicted of High BAC must serve 48 consecutive hours in jail while individuals with a Highest BAC conviction must spend at least 72 consecutive hours in jail.

License Suspension – After jail time is served, individuals will have their licenses suspended. During that time the individual is also on probation. If your BAC is below .10 percent, you may not have your license suspended on your first offense, but you will for any subsequent DUI offense. If your BAC is.10 percent or higher, you will receive a 12-month license suspension for your first offense and an 18-month suspension for following offenses. If caught driving without a license, you will be incarcerated for 60 days, fined $500 and lose your license for 12 additional months more.

Fines – The following fines are associated with each conviction: $300 for general BAC, $500 to $1,000 for High BAC and $1,000 to $5,000 for Highest BAC.

Driving School – Attendance of an alcohol highway safety school is also mandatory in PA for all convicted DUI first and second offenders.

ARD Program (Accelerated Rehabilitative Disposition) – If you are facing a first time offense DUI charge, you may be offered an alternative to the traditional criminal court case, which is called the Pennsylvania ARD Program (Accelerated Rehabilitative Disposition). PennDOT will automatically expunge ARD records after 10 years providing a person’s operating privileges were not revoked as a habitual offender and/or the person was not a commercial driver at the time of the violation. Your attorney will help you determine if you are eligible.

Occupational Limited Licenses (OLL’s) – First time DUI offenders may be eligible for an Occupational Limited License after serving 60 days of their suspension. Individuals whose licenses are suspended for 18 months (for DUI or refusing breath or chemical testing) and have no more than one prior offense may be eligible for an OLL with an ignition interlock after serving 12 months of their suspension.

Ignition Interlock – Drivers that have received two or more DUI violations must install an ignition interlock in every vehicle he or she owns, although they may apply for a financial hardship exemption with PennDot that permits them to install it only in one.

Thirty days prior to an individual’s restoration eligibility date, PennDOT will mail the individual a Restoration Requirements Letter.  This letter includes an application for the ignition interlock license.  You should complete the application for the Ignition Interlock License and send it to PennDOT as quickly as possible.

• Current registration.  If you aren’t the registered owner of the vehicle, the owner will need to be present at the time of installation, or you’ll need a notarized permission slip from the registrant that it is okay to install the ignition interlock.
• Proof of insurance
• Restoration Requirements Letter from PennDOT.

_____ Complete a DL-21SC form (Self-Certification of Vehicle(s) Owned/Operated) and either fax it to LifeSafer at 855-282-6357 or scan the completed form and email it to LSPA@lifesafer.com.  If you apply for a hardship exemption, you must include your most recent federal income tax return.  The form must be completed even if you don’t own a vehicle.  This information has to be verified with PennDot prior to the installation.  LifeSafer will verify the information against the PennDOT vehicle database.  Once we determine that you either don’t own any vehicles or that the device has been installed on all applicable vehicles, the information is sent to PennDOT.

If the restoration requirements have been met and the application for the Ignition Interlock License was received, PennDOT will restore your driving privilege and issue your Ignition Interlock License.

Hardship Exemption – Hardship exemptions are based on an individual’s income level.  If you apply for a hardship exemption, you must include your most recent federal income tax return when you submit your DL-21SC (Self Certification of Vehicle(s) Owned/Operated form to the Installation Service Center.

Employment Exemption – If you have an Ignition Interlock License and you are required to drive an employer-owned vehicle for employment purposes, you may have your employer complete a DL-3805 form (Ignition Interlock Employment Exemption Affidavit).  This allows you to operate an employer-owned vehicle not equipped with an ignition interlock for employment purposes.  This cannot be used to drive a school bus, school vehicle, or vehicles designed to transport more than 15 passengers.

If this is your 1st offense you will be applying for a Monitoring Device Driving Permit (MDDP). To help you get back on the road quickly we’ve developed the Ignition Interlock BAIID checklist.

Do I qualify for an MDDP Program?

• A driver under age 18 is not eligible for a Monitoring Device Driving Permit (MDDP).
• A first-time offender is a driver who has not received any previous statutory summary suspension, has not been convicted of DUI or assigned court supervision for DUI in Illinois, or has not been convicted of a DUI in another state within five years.
• An offender is ineligible for an MDDP if his/her driver’s license is otherwise invalid; if death or great bodily harm resulted from the DUI incident; or if he/she has previously been convicted of reckless homicide or aggravated DUI that resulted in a death.
• A commercial driver’s license holder may be eligible for an MDDP for driving a non-commercial vehicle if he/she is a first-time offender; however, an offender may not operate a commercial vehicle.
• If you need to drive an employer owned vehicle(s) during work hours and the vehicle is not specifically assigned to you, you may be eligible for a work exemption. To verify eligibility, you must provide your employer’s name, address and telephone number to the court.
• Work exemptions are not granted if you are self-employed or work for a business owned by a family member.
• If your MDDP is revoked due to conviction anytime during your summary suspension, you must re-apply and get approved for a Restricted Drivers Permit (RDP) in order to resume driving privileges.

Steps in obtaining a MDDP

• Sometime during the initial 46 days following a DUI, you will receive notice from the Illinois Secretary of State regarding your Statutory Summary Suspension start date, as well as, an application for the MDDP permit as a tear-off slip located at the bottom of the notice.
• Complete and send in the MDDP application. You can mail it to the address located on the application or Fax to (217) 785-5239. Within 48 hours after your MDDP application is received by the ILSOS, they will send a requirements package to you.
• Complete the requirements package. You are required to pay a $30 per month monitoring fee, plus an $8 permit printing fee to the Secretary of State. The fees must be paid in full prior to issuance of the MDDP. Send the requirements package with payment back to the ILSOS where the approval process takes 7-10 days.
• After a complete review of the court order, the Secretary of State’s office will notify you of issuance of the MDDP. The permit then gets mailed to you. Note: MDDPs that have been approved by the State will not be sent until you are within two weeks or less before the 31st day your suspension.
• Once the MDDP is issued, you have 14 days to have a Breath Alcohol Ignition Interlock Device (BAIID) installed on all vehicles you wish to drive during the suspension period. Contact LifeSafer of Illinois, (888) 812-9495, to set your installation appointment.
• You are responsible for all fees associated with the MDDP; including monitoring fees paid to the Secretary of State and BAIID fees paid to LifeSafer. (Those proclaimed indigent by the state may have some monitoring fees waived). Your LifeSafer representative will let you know what your payments will be during your program.

Do I Qualify for an RDP

A Breath Alcohol Ignition Interlock Device (BAIID) is also required as a condition of receiving a Restricted Driving Permit (RDP) for a person who has two to five DUI convictions (no time limit between offenses); or two statutory summary suspensions (as a result of two DUI arrests) within 10 years; or one DUI conviction with a statutory summary suspension from a separate DUI arrest within 10 years. An RDP allows a person to drive on a restricted basis according to his/her permit.

RDP Facts

• A multiple offender, between 2 – 5 convictions, whose BAC test results were .08 or above or whose chemical test indicated any amount of a controlled substance, is not eligible for an RDP during the statutory summary suspension period, 6 to 12 months depending on the circumstances of the arrest.
• A multiple offender who refuses to submit to or fails to complete chemical testing is not eligible for an RDP during the suspension period.
• A driver under age 16 whose driving privileges are revoked is not eligible for an RDP.

Obtaining an RDP

• To obtain an RDP, you must prove a hardship exists, provide a current professional alcohol/drug evaluation and, when appropriate, provide proof of remedial education or treatment. You must go to a state approved substance abuse center for evaluations and treatment.
• Fill out the “Formal Hearing Request Form” and send it via U.S. mail to one of the Administrative Hearing offices addresses provided. Faxes or e-mail requests are not accepted. Petitioners are eligible for a subsequent hearing 90 days after their most recent hearing.
• A driver requesting a Formal Hearing for an RDP or reinstatement of his/her driving privileges will be charged a $50 non-refundable filing fee when requesting the formal hearing (see section on formal hearings[SS1].)
• Once you are approved for the program by the Secretary of State Dept of Admin Hearings, you will receive notification and an RDP in the mail. Within 14 days of the issuance date of your permit, you are required to install the BAIID in any and all vehicles in your name.
• Contact LifeSafer of Illinois, (888) 812-9495, to set up an installation appointment. Be sure to have your permit with you at the time of installation.

Formal Hearings

A formal hearing is required for a driver whose privileges have been suspended or revoked for an offense(s) involving a fatality or multiple DUI dispositions. A formal hearing request must be made in writing through U.S. mail using the Formal Hearing Request Form. Faxes or e-mail requests are not accepted. Petitioners are eligible for a subsequent hearing 90 days after their most recent hearing.

A hearing officer presides at a formal hearing at which both testimony and documentary evidence is heard. The officer is authorized to rule on all motions, administer oaths, subpoena witnesses or documents at the request of any party, examine witnesses, and rule upon the admissibility of evidence. An order reflecting the recommendation of the hearing officer and the decision of the Secretary of State’s office is issued. Decisions from a formal hearing are subject to the Administrative Review Law.

By law, a Formal Hearing Request must be accompanied by a non-refundable $50 filing fee in the form of a check, money order or credit card payable to Secretary of State. Cash is not accepted. Upon receipt of a Formal Hearing Request and the filing fee, a hearing will be scheduled and a Notice of Hearing will be mailed to the petitioner. If a request is received without the required fee, the request will be returned and a hearing will not be scheduled. Be sure to provide the following information:

• Full name (include middle initial)
• Current address (include P.O. Box #, Apt. #, or Lot #)
• Telephone number (day and evening)
• Date of birth
• Illinois driver’s license number or reference number (if available)
• Social Security number
• Year and state of last alcohol/drug-related arrest
• E-mail address (if available)
