Ignition Interlock Ohio – Laws

Lifesafer Ignition Interlock OhioOhio state laws require the installation of ignition interlock devices (IID) for first-time and all other offenders of the state’s operating a vehicle while intoxicated (OVI) laws. The IID is connected to the vehicle’s ignition system. The driver is required to submit a breath sample prior to starting the vehicle. If the device detects an breath alcohol content that is above a preset limit, the vehicle will not start. The device requires breath samples while the offender is operating the vehicle. These “rolling re-tests” are mandatory. The results of the breath samples, including breath alcohol content and missed or failed tests, are recorded on the device.

Offenders are required to obtain IIDs from service providers that are certified by the State of Ohio. IIDs must be serviced at an interval specified by the service provider. During the service appointments, the provider will download all data from the device and inspect the device for evidence of circumvention or tampering. The service provider will report all violations to the court. The courts may pursue additional legal actions if the offender is found in violation of the court order. Tampering with or attempting to circumvent the device will result in a court order for the offender to wear a continuous alcohol monitor.

For all alcohol-related convictions, including first time offenses, the courts will order the installation of an IID in the offender’s vehicle. In cases of drug-related convictions, the court may order the installation of an IID in the offender’s vehicle. Individuals convicted of OVI-related offenses are prohibited from operating commercial motor vehicles.

State Seal of OhioOVI convictions will result in driving privileges being suspended. Individuals who refuse chemical tests may have their driving privileges suspended by the court. Offenders who serve a minimum period of their suspension period may be eligible for limited driving privileges. Restricted licenses can be obtained once the court orders the IID restriction. The restricted license includes a statement indicating that the offender is restricted to operating IID-equipped vehicles.

The court will consider the offender’s history of OVI-related convictions when determining the suspension period. Offenders who are convicted of their second OVI within six years of their first conviction will have their driving privileges suspended for a period of one to five years. Offenders who are convicted of two OVI-related offenses in a six-year period will have their driving privileges suspended for a period of one to ten years. Three or more OVI-related convictions within a six-year period will result in driving privileges being suspended for at least three years and may result in the permanent suspension of driving privileges.

The State of Ohio recognizes that the suspension of driving privileges could seriously affect the offender’s ability to maintain employment. In these cases, the court may grant occupational driving privileges to the offender. As a condition of these driving privileges, the offender must have IIDs installed on any and all vehicles they own or may use to drive to and from work.

Offenders are required to pay any and all costs associated with the Ignition Interlock Devices including installation, recalibration, servicing and removal.
