Kentucky Dui Law Is Changing On July 1

You will soon have a choice.

Effective July 1, 2020, Kentucky Ignition Interlock/DUI Law will be changing. Here’s a summary of the changes:

After that date, if you receive a DUI charge in Kentucky, you will have the choice of regular license suspension or using an ignition interlock device. Kentucky is making the incentive to use an ignition interlock very attractive. In essence, choosing an interlock means a decrease in the duration of the program (see below).

Having anywhere from 2 months to 30 months shaved off the suspension time is huge. Who wouldn’t want to decrease the time of suspension, right?

How does this change affect offenders?

No matter if it is your first offense or your fourth offense, you can significantly decrease the time your license is suspended by choosing an ignition interlock. You are also being given the choice of driving versus not driving at all. That has quite an impact on how you can continuously go about your daily life without undue inconvenience.

Once a conviction is given, offenders will deal only with the DOT. One agency to interact with means better communication, less confusion, and a faster process.

How does this change affect the Kentucky courts?

Streaming the process and giving all administrative duties to the DOT will free up the courts and judges to be able to focus on judicial decision making. This is especially important as we are seeing the courts reopen in Kentucky and wading through the backlog of cases due to COVID-19. Courts will be able to get through DUI cases quicker since they no longer have to focus on the administrative details post-conviction.
